Terms of Service

These Terms of Service ("Terms") govern your access to and use of ProfitPOD (the "Service"), operated by ProfitPOD ("ProfitPOD", "we", "us", or "our"). By creating an account, installing ProfitPOD from the Shopify App Store, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

ProfitPOD is a profit-tracking tool for e-commerce and print-on-demand sellers. It connects to third-party platforms you authorize — such as your store, fulfilment provider, and advertising accounts — and calculates metrics including revenue, costs, fees, and net profit to help you understand your business.

2. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use the Service. Installing ProfitPOD from the Shopify App Store creates your account and is how you sign in, so access follows your Shopify account. You are responsible for keeping that account secure, for the accuracy of the information you provide, and for all activity under your account. Notify us promptly of any unauthorized use.

3. Subscriptions, billing, and cancellation

The Service is offered on a paid subscription basis. Because ProfitPOD is a Shopify app, your subscription is billed by Shopify and charged to the payment method on your Shopify account, appearing on your regular Shopify invoice. Current pricing and billing frequency are shown in the Shopify App Store and within the app at the time you subscribe.
Your subscription renews automatically each billing period until you cancel.
You can cancel at any time by uninstalling ProfitPOD from your Shopify admin, or by managing the subscription there. Cancellation takes effect at the end of the current billing period, and you retain access until then.
Except where required by law, payments are non-refundable, and partial billing periods are not prorated. Any refund is handled by Shopify under its own billing terms.
We may change our pricing from time to time. Any change applies to subsequent billing periods, and we will provide reasonable prior notice where required.

4. Connecting third-party platforms

The Service lets you connect third-party platforms (for example Shopify, Gelato, Printify, Printful, Meta Ads, Google Ads and TikTok Ads). You are responsible for complying with those platforms' terms, and you represent that you have the right to grant ProfitPOD access to the accounts and data you connect. We are not responsible for the availability, accuracy, or acts of those third parties, and their access may change or be revoked by them at any time.

5. Acceptable use

You agree not to misuse the Service, including by attempting to access accounts or data that are not yours, reverse-engineering or disrupting the Service, reselling or redistributing the Service without our permission, or using it to violate any law or third-party rights.

6. Intellectual property

The Service, including its software, design, and content (excluding your data), is owned by ProfitPOD and protected by intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your own business purposes. You may not copy, modify, distribute, sell, or create derivative works from the Service. If you send us feedback or suggestions, we may use them to improve the Service without any obligation to you.

7. Your data

You retain all ownership of the data in your account, including the data we access from the platforms you connect. You grant ProfitPOD a limited licence to store, process, and display that data solely to operate and provide the Service to you and as described in our Privacy Policy. You are responsible for having the rights and permissions necessary to connect the accounts and data you link to the Service.

8. Not financial, tax, or accounting advice

ProfitPOD provides calculations and estimates based on the data available from your connected platforms and the inputs you provide. It is an informational tool only and does not constitute financial, investment, tax, accounting, or legal advice. Figures — including profit, margin, fees, and VAT — are estimates that may not match your official accounting or tax records. You are solely responsible for your financial and tax decisions and should consult a qualified professional.

9. Privacy

Our handling of your information is described in our Privacy Policy, which is incorporated into these Terms by reference.

10. Availability and changes

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features at any time.

11. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and any warranty as to the accuracy or completeness of the data or calculations provided.

12. Limitation of liability

To the maximum extent permitted by law, ProfitPOD will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless ProfitPOD from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, your violation of any law or third-party right, or the data and accounts you connect to the Service.

14. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms or use the Service in a way that risks harm to us, other users, or third parties. On termination, your right to use the Service ends; sections that by their nature should survive (including 6, 7, 8, 11, 12, 13, and 15) will survive.

15. Governing law

These Terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable there, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction of the courts located in Ontario for any dispute not subject to arbitration or small-claims resolution.

16. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the effective date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
